THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. APK POOL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.
Limitation of Liability
APK POOL SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL APK POOL TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE.
Indemnification
You agree to indemnify, defend, and hold APK POOL and its affiliates, officers, directors, employees, agents, and licensors harmless from all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these TOS.
Termination
APK POOL reserves the right to terminate your access to the Service at any time, with or without cause and without prior notice. You may discontinue using the Service if you wish to terminate your account.
Governing Law
These TOS shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Pakistan for any disputes arising under these TOS.
Entire Agreement
These TOS constitute the entire agreement between you and APK POOL regarding your use of the Service, superseding any prior agreements between you and APK POOL. If any provision of these TOS is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
